Terms of Service

Please read these Terms of Service ("Terms") carefully before using the CROMULTY platform operated by Search Leads ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Acceptance of Terms

By creating an account or using the CROMULTY platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all users of the Service, including account holders, team members, and any person accessing the Service on behalf of an organization.

2. Description of Service

CROMULTY is a conversion rate optimization (CRO) and A/B testing platform that enables you to:

  • Create and manage A/B tests and experiments on your websites
  • Track visitor behavior including page views, clicks, and conversions
  • Analyze test results with statistical significance calculations
  • Manage content translations for multilingual testing
  • Generate AI-powered content suggestions for test variants

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Responsibilities

When creating and maintaining your account, you agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain the security of your account credentials (email and password).
  • Not share your account with others or allow unauthorized access.
  • Maintain only one account per individual (team access should be managed through organization features).
  • Promptly notify us of any unauthorized use of your account.
  • Accept responsibility for all activity that occurs under your account.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You must NOT:

  • Use the tracking script to collect personally identifiable information (PII) such as names, email addresses, or financial data from website visitors without proper consent and legal basis.
  • Deploy tracking in a manner designed to deceive, mislead, or harm website visitors.
  • Use the Service to distribute malware, phishing content, or malicious code through test variants.
  • Harvest or collect visitor data for purposes of unsolicited communications (spam).
  • Attempt to circumvent rate limits, security measures, or access controls.
  • Use the Service to violate any applicable local, state, national, or international law or regulation.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • Use the Service on websites that primarily distribute illegal or harmful content.

5. Intellectual Property

Our Property

The CROMULTY platform, including its source code, design, logos, documentation, and all related intellectual property, is owned by Search Leads. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

Your Property

You retain ownership of all content, data, and materials you create, upload, or generate through the Service, including test configurations, variant content, and analytics data. You grant us a limited license to process and display this content solely to provide the Service.

6. Service Availability

We strive to maintain high availability of the Service but provide it on a "best-effort" basis. We do not guarantee any specific uptime or service level agreement (SLA). The Service may be temporarily unavailable due to:

  • Scheduled maintenance windows (we will provide advance notice when possible).
  • Emergency maintenance or security patches.
  • Circumstances beyond our reasonable control (force majeure).

We are not liable for any loss or damage arising from Service interruptions or downtime.

7. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL SEARCH LEADS, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to indemnify and hold harmless Search Leads and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

9. Termination

Either party may terminate the relationship at any time:

  • By you: You may delete your account at any time through the account settings or by contacting us.
  • By us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or for any other reason with reasonable notice.

Upon termination:

  • Your access to the Service will be revoked.
  • You will have 30 days to export your data before it is permanently deleted.
  • Sections of these Terms that by their nature should survive termination will remain in effect (including Limitation of Liability, Indemnification, and Governing Law).

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Search Leads is established, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the competent courts of that jurisdiction.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.
